Introduction

These terms and conditions of use (hereinafter referred to as the “Terms and Conditions”) govern your use of the attestra.com website, hereinafter referred to as the “Site”, and represents all the rights and obligations binding Attestra (“ATTESTRA”) and any user of the Site. No verbal or written declaration by an ATTESTRA employee may have the effect of modifying or substituting these terms and conditions.

Please read these terms and conditions carefully before using the Site, because by accessing or using the Site in any way, you agree to be bound by these terms and conditions.

If you do not accept these terms and conditions, that is your right, but you must immediately cease all use of the Site.

  1. Without warranty

The Site is intended to provide general information about traceability solutions, and the content available is for informational purposes only. ATTESTRA may modify or delete, at its discretion, any part of the Site at any time, with or without notice to users.

No guarantee is given that the Site will be accessible and functional, in whole or in part, at all times. We reserve the right to suspend access to the Site for the public as a whole or for one or more visitors or users in particular for any period at our sole discretion.

  1. Limitation of liability

The Site is provided “as is” and ATTESTRA makes no representations or warranties as to its operation, accessibility or suitability for any particular purpose, and to the fullest extent permitted by law, ATTESTRA disclaims all liability for any damages or injury arising from the use of the Site.

Use of this Site constitutes acceptance of these terms and conditions, and you hereby waive the right to exercise any recourse against ATTESTRA or its employees based on a matter excluded from this article of the terms and conditions.

  1. Intellectual property

The content of this Site, including but not limited to text, graphics, images, video, audio, logos and source code, are protected by intellectual property laws and is the property of ATTESTRA.

Names, words, titles, phrases, logos, designs, graphics, icons and brands displayed on the Site may constitute trademarks of ATTESTRA or third parties.

We take reasonable steps not to infringe intellectual property rights when posting content on the Site.  However, this cannot be guaranteed and we will remove any material that infringes a third party’s intellectual property right when it is brought to our attention.

You may not reproduce, distribute, modify, publicly display, transmit or in any way exploit the content of the Site without our prior authorization.

You are not permitted to use the Site or its functionalities for any purpose that is illegal or prohibited by these terms and conditions:

Use of these websites is subject to the terms and conditions of use specific to these sites.

With respect to your privacy and the confidentiality of your personal information, ATTESTRA is subject to the Act respecting the protection of personal information in the private sector (RLRQ, chapter P-39.1), hereinafter the “Act”.

In addition, our Privacy Notice describes our privacy practices, including what personal information we collect and process about you, how we use it and for what purposes.

  1. Applicable laws, jurisdiction and settlement of disputes

These terms and conditions are governed by the laws of the province of Quebec, Canada. Any dispute arising from the use of the Site shall be subject to the exclusive jurisdiction of the courts of the province of Quebec.

Some jurisdictions do not allow a contract to be governed by the laws of another jurisdiction. Consequently, this section may not apply to you.

  1. Language translation

The French version of these terms and conditions prevails over any other translation in order to avoid any difference in interpretation.

We reserve the right to make changes to these terms and conditions at our sole discretion and without prior notice, so it is your responsibility to check the terms and conditions regularly to keep informed of any changes.
